3. Required Elements of a Takedown Notice
In accordance with 17 U.S.C. § 512 (c)(3), a notification of claimed infringement must include all six of the elements listed below. Notifications that fail to substantially comply with these requirements may not be legally effective and may not be actionable.
- A physical or electronic signature of the copyright owner, or of a person authorized to act on the owner's behalf.
- Identification of the copyrighted work claimed to have been infringed (or, where multiple works are involved, a representative list of such works).
- Identification of the material claimed to be infringing and information reasonably sufficient to allow us to locate that material on the service (for example, the URL of the article).
- Information reasonably sufficient to allow us to contact the complaining party — name, postal address, telephone number, and email address.
- A statement that the complaining party has a good faith belief that the disputed use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notification is accurate and that the complaining party is the copyright owner or is authorized to act on the owner's behalf.
4. Counter-Notification Procedure
A subscriber or user whose material has been removed or disabled may submit a counter-notification under 17 U.S.C. § 512 (g)(3). A valid counter-notification must include all four of the following elements.
- A physical or electronic signature of the subscriber.
- Identification of the material that has been removed or to which access has been disabled, and the URL at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification, together with the subscriber's consent to the jurisdiction of the United States District Court for the judicial district in which the subscriber's address is located (or, for subscribers outside the United States, any judicial district in which the service provider may be found) and to accept service of process from the complaining party (or its agent).
- The subscriber's name, postal address, and telephone number, with all factual representations made under penalty of perjury.
Upon receipt of a compliant counter-notification, we will forward a copy to the original complaining party. Unless that party files an action seeking a court order against the subscriber within 10 business days, we will, as a general rule, restore the material between 10 and 14 business days after receipt of the counter-notification.
5. Repeat Infringer Policy
In accordance with 17 U.S.C. § 512 (i), we have adopted and reasonably implement a policy that provides for the termination, in appropriate circumstances, of accounts of subscribers and account holders of our service (including member accounts on worldwatch.media) who are determined to be repeat infringers of copyright.
